Terms of Service

These Terms of Service ("Terms") govern your use of ShowcaseLoop (the "Service"), operated by an independent, duly registered sole proprietorship trading as ShowcaseLoop ("we", "us"; registration details available on request via the contact address below). By creating an account or using the Service you agree to these Terms. If you use the Service on behalf of a company or brokerage, you represent that you are authorized to bind that organization, and "you" includes it.

1. The Service

ShowcaseLoop generates videos from photographs you provide, using artificial intelligence to add camera motion, ambience effects (such as twilight lighting), overlays, captions, voiceover and music. The Service is provided on a subscription and/or prepaid-credit basis as described on our pricing page.

The Service depends on third-party infrastructure — cloud hosting, GPU compute and AI model providers, payment processing and email delivery. We select and may change these providers at any time. Their availability, pricing and output quality are outside our control, and the Service inherits their limitations.

The Service is intended for business and professional use (real-estate agents, brokerages, photographers, marketers). You must be at least 18 years old to use it. It is not directed at consumers or children.

2. Your content and rights warranty

You retain ownership of the photos and property information you upload ("Your Content"). By uploading, you grant us a worldwide, non-exclusive license to host, process, transform, reproduce and display Your Content as needed to provide, secure and improve the operation of the Service (this does not include training AI models on Your Content — see our Privacy Policy).

You warrant that you own or have obtained all rights necessary to use the photos you upload — including any rights held by the photographer, brokerage, property owner or MLS — and that your use of the resulting videos complies with your MLS rules, association rules and applicable law (including fair-housing and advertising law). We have no ability to verify your rights and rely entirely on this warranty. You are solely responsible for Your Content and for any claims arising from it.

3. Generated videos

Subject to payment, we assign to you all right, title and interest we may have in the videos generated from Your Content ("Output"), and you may use them for marketing the associated property without attribution. To the extent any element of the Output (such as AI-composed music or templates) cannot be assigned, we grant you a perpetual, worldwide, royalty-free license to use it as part of the Output for any lawful commercial purpose. Videos generated on a free trial carry a watermark and are licensed for evaluation only; you may not remove or obscure the watermark.

No model training. Notwithstanding the assignment and license above, you may not use the Service or any Output to train, fine-tune, distill or otherwise develop any machine-learning or AI model, or to create model weights or adapters (such as LoRAs) — whether you do so yourself or a third party does so on your behalf — and you may not provide Output to others for that purpose. This does not restrict ordinary use of Output with AI-powered tools (for example captioning, scheduling or ad-platform optimization) that do not retain it as training data. The same boundary applies to us: we do not train AI models on Your Content or your Output (see our Privacy Policy).

Because Output is AI-generated: (a) the legal protectability of AI-generated works varies by jurisdiction and we make no warranty that Output is protectable by copyright; (b) similar or identical output may be independently generated for other customers, and we make no warranty of uniqueness; and (c) synthetic voiceover voices are AI voices, not recordings of a real person's endorsement — you must not present them as a specific real person or use them to impersonate anyone.

4. AI-generated content — your review duty

Videos are AI-generated interpretations of your photographs. The AI adds simulated camera movement and may alter lighting and ambience (for example, the twilight effect). AI systems are probabilistic: while the Service is designed not to invent or remove features of a property, and generated clips are automatically checked against your source photos, no automated check is perfect and output may contain artifacts, distortions or inaccuracies.

• Review before use. You must review every video for accuracy before using it in marketing. Publishing a video is your decision and your responsibility.
• Disclose where required. Many MLSs, associations and jurisdictions require disclosure of AI-modified or digitally altered imagery. Determining and complying with such rules is your responsibility.
• Videos must not be used to misrepresent the condition, features or boundaries of a property.
• Nothing in the Service is legal, compliance or professional advice.

5. Accounts

You are responsible for your account credentials and for all activity under your account. Notify us promptly of any unauthorized use. We may refuse, suspend or close accounts that violate these Terms.

6. Plans, credits, payments and refunds

• Payments are processed by our payment provider, which acts as merchant of record; we never store card numbers. Prices are as shown at checkout and may include taxes handled by the payment provider.
• Plans renew automatically until cancelled; cancellation takes effect at the end of the paid period, with access continuing until then.
• Monthly credit grants refresh each billing cycle and are for use during your subscription. Purchased credit packs are valid for 12 months from the date of purchase; unused pack credits lapse after that, except where applicable law prohibits or limits the expiry of prepaid credit. Credits have no cash value, are non-transferable, and are not redeemable for money except where the law requires.
• Failed generations: credits for generations that fail for technical reasons are automatically returned to your balance. A completed video that you find subjectively unsatisfactory (framing, motion, style, music taste) is not a failed generation — AI output varies by nature, and the re-shoot and update tools exist for this purpose.
• Except as stated above or required by applicable law, payments are non-refundable, including for partially used billing periods and unused monthly credits. Nothing in these Terms limits statutory rights that cannot be waived.
• We may change prices and credit costs prospectively; changes never affect credits you have already purchased or the current paid period.

7. Fair use of compute

Video generation consumes substantial GPU compute. We may apply rate limits, queue jobs, prioritize traffic and set reasonable concurrency caps to keep the Service working for everyone. Turnaround times are estimates, not commitments. We may suspend accounts that abuse the Service — including automated bulk misuse, attempts to circumvent limits or credit accounting, or usage patterns that materially degrade the Service — with credits held for in-flight abusive jobs forfeited.

8. Acceptable use

• No uploading content you lack rights to, or content depicting identifiable private individuals without their consent.
• No unlawful, deceptive, discriminatory or infringing use, including misrepresenting a property or violating fair-housing law.
• No sexual, exploitative or hateful content; no content involving minors in any inappropriate way.
• No use of voiceover or generated media to impersonate a real person or spread disinformation.
• No reverse engineering, scraping, benchmarking-for-competitors, reselling of the Service itself, or removing watermarks (resellers: see the Reseller/Agency tier).
• No using the Service or Output to train, fine-tune or distill AI models or model weights such as LoRAs (see §3).
• No interfering with the Service's security, rate limits or billing.

9. Availability, changes and data

We aim for high availability but the Service is provided without any uptime guarantee or SLA. Features may change, be added or be withdrawn; features marked beta or experimental may be modified or removed at any time. The Service is not a backup or archival service: keep your own copies of original photos and download videos you care about. We may delete stored media a reasonable period after account closure, and we are not liable for loss of stored content.

10. Our intellectual property; feedback

We (and our licensors) own the Service — software, models, templates, designs and branding. These Terms grant you no rights in them beyond use of the Service. If you send us feedback or suggestions, we may use them without restriction or compensation.

11. Copyright complaints

If you believe content processed through the Service infringes your copyright, email hello@showcaseloop.com with the work, the allegedly infringing material, your contact details and a good-faith statement. We will review and, where appropriate, remove content and may terminate repeat infringers.

12. Suspension and termination

You may stop using the Service and cancel at any time. We may suspend or terminate your account — with or without prior notice — if we detect abuse of the Service or use of it in a manner it is not intended or designed for (including, without limitation, the conduct described in Sections 7 and 8), or if you materially breach these Terms, create legal risk for us, or fail to pay. On termination for breach or abuse, unused credits are forfeited to the extent permitted by law. Sections 2–4, 10 and 13–16 survive termination.

13. Disclaimers

THE SERVICE AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED — INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. Software has bugs and AI output is probabilistic; we do not warrant that any video will be accurate, complete, compliant with your MLS or advertising rules, or fit for a particular listing. We are not responsible for third-party services the Service depends on or integrates with.

14. Indemnification and limitation of liability

You will defend and indemnify us against third-party claims arising from Your Content, your use of Output in marketing, or your breach of these Terms or applicable law (including MLS and fair-housing rules).

TO THE MAXIMUM EXTENT PERMITTED BY LAW: our aggregate liability for all claims arising out of or relating to the Service is limited to the amounts you paid us in the twelve months preceding the claim; and we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, goodwill or data — even if advised of the possibility. Nothing in these Terms excludes liability that cannot be excluded by law (such as for fraud, or for intent or gross negligence where applicable). If a jurisdiction does not allow a limitation above, it applies to the fullest extent permitted there.

15. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which the operator of ShowcaseLoop is established, excluding its conflict-of-law rules, and disputes are subject to the exclusive jurisdiction of the courts of that place — except where the law of your country of residence grants you non-waivable consumer protections or venue rights. Before filing any claim, you agree to contact us and attempt to resolve the dispute informally for 30 days.

16. General

These Terms (with the Privacy Policy) are the entire agreement between us regarding the Service. If a provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale. We may update these Terms; material changes will be notified via the Service or email, and continued use after changes take effect constitutes acceptance.
